3. Consumers and business customers

These Terms may apply to both consumers and business customers unless a provision states otherwise.

A consumer is a natural person entering into a legal transaction for purposes that are predominantly outside their trade, business or profession.

A business customer / entrepreneur is a natural or legal person or partnership with legal capacity acting in the course of its commercial or independent professional activity.

Where mandatory consumer-protection law applies, these Terms do not restrict those rights.

4. Website information

Plan Save Shine publishes editorial and practical content relating to life and financial topics in Germany.

Public website content is provided for general informational purposes unless a page explicitly states that a personalised professional service is being provided.

The website does not create a professional financial, tax, legal, medical or other advisory relationship merely because a user reads content, downloads a general resource, joins The Shine Club or attends a general educational event.

Information can become outdated as laws, regulations, product conditions or administrative processes change.

Plan Save Shine may update, correct, archive or remove content where appropriate.

If an event is materially changed:

Any right to retain fees must be legally reviewed.

7.7 Force majeure / events beyond reasonable control

Where performance is prevented or materially affected by circumstances outside reasonable control:

This provision must not remove statutory refund, termination or consumer rights that cannot legally be excluded.

8. Right of withdrawal for consumers

8.1 General rule

Where a consumer enters into a distance contract and no statutory exception applies, a statutory right of withdrawal may exist.

The general withdrawal period under § 355 BGB is 14 days.

The exact withdrawal information applicable to a purchase must be provided before the consumer is bound by the contract.

8.2 Services beginning during the withdrawal period

If a consumer expressly requests that a paid service begin before the withdrawal period has expired, the legal consequences depend on the service and the applicable statutory requirements.

8.3 Events on a specific date

German law provides exceptions to the right of withdrawal for certain services connected with leisure activities where the contract provides for a specific date or period.

Where an exception applies, the customer must be informed before the order that no statutory withdrawal right exists.

8.4 Digital content

If paid digital content is supplied without a physical medium, the withdrawal right can be affected by the consumer's express consent to immediate performance and acknowledgement of the relevant legal consequence.

8.5 Financial services

Financial services can be subject to activity-specific withdrawal and information rules.

These general Terms do not replace the withdrawal information required for a regulated financial-services contract.

9. Online ordering requirements

If the website allows consumers to enter into paid contracts online, the checkout must display the legally required information clearly before the final order.

This can include:

  • essential characteristics of the service;
  • contracting entity;
  • total price and taxes;
  • additional costs;
  • payment conditions;
  • performance / event date;
  • contract duration where relevant;
  • applicable withdrawal information.

Where the final order creates an obligation to pay, the final button must expressly indicate that obligation.

10. Financial services and product decisions

General content, workshops or resources do not constitute a promise that a particular financial product or strategy is suitable for the participant or reader.

Where Plan Save Shine provides regulated financial advice or intermediation:

  • the applicable professional status must be disclosed;
  • the individual client's circumstances must be considered where required;
  • relevant statutory and contractual documents apply;
  • product risks, costs and conditions must be provided as required;
  • the separate Regulatory & Financial Disclosure applies.

Unless expressly incorporated, the regulated financial client documents prevail over these website Terms in the event of conflict.

11. Tax, legal, health and other specialist matters

Plan Save Shine may publish general information touching on tax, legal, health or other specialist subjects.

Unless expressly stated otherwise, this does not constitute individual professional advice in those fields.

Individual tax advice requiring professional tax-advisory authorisation should be obtained from an appropriately authorised professional.

Formal referral / cooperation arrangements:
None. Plan Save Shine has no formal referral or cooperation arrangement with a tax adviser or other professional.

12. User conduct

  • maintenance;
  • security work;
  • provider outages;
  • technical failure;
  • circumstances outside reasonable control.

Plan Save Shine must still provide paid digital services in accordance with applicable contractual and statutory obligations.

15. Liability

Statutory liability applies.

Nothing in these Terms is intended to exclude or restrict liability where exclusion or restriction is legally prohibited, including where applicable liability for:

  • intent;
  • gross negligence where exclusion is not permitted;
  • death or personal injury;
  • mandatory product-liability rules;
  • fraudulently concealed defects or guarantees;
  • other mandatory statutory liability.

16. Links to third-party services

The website may link to third-party websites and services.

Plan Save Shine does not control third-party websites merely because a link is provided.

Third-party services are governed by their own terms and privacy information.

This does not affect any responsibility that Plan Save Shine cannot legally exclude.

17. Changes to services and these Terms

Plan Save Shine may update these Terms where there is a legitimate reason, including:

  • changes in law;
  • changes in services;
  • security requirements;
  • technical changes;
  • clarification of existing provisions.

Changes must not retroactively remove accrued consumer rights.

18. Contract language

Mandatory consumer rights concerning language and pre-contract information remain unaffected.

19. Governing law

These Terms are governed by the law of the Federal Republic of Germany.

For consumers, this choice of law does not deprive the consumer of mandatory protections that would apply under the law of the country of their habitual residence where such protections cannot validly be excluded by agreement.

20. Jurisdiction

For consumers, the competent court is determined by applicable mandatory law.

21. Consumer dispute resolution

Plan Save Shine must disclose whether the contracting entity is willing or required to participate in dispute-resolution proceedings before a consumer arbitration body where the VSBG disclosure duties apply.

Under § 36(3) VSBG, an undertaking that employed ten or fewer persons on 31 December of the previous year is exempt from the general information duty in § 36(1)(1). Separate information duties can still arise after an unresolved consumer dispute under § 37 VSBG.

Activity-specific dispute-resolution bodies for insurance and other regulated financial activities are identified in the Regulatory & Financial Disclosure where applicable.

22. Complaints

Activity-specific complaints and ombudsman information for regulated financial services may also apply.

23. Privacy

Personal-data processing is governed by the Privacy Policy.

Use of cookies and similar technologies is described in the Cookie Policy.

These Terms do not replace data-protection or cookie consent where consent is required.

24. Severability and mandatory law

If an individual provision of these Terms is invalid or unenforceable, the legal consequences are determined by applicable law.

No invalid provision should automatically be replaced by a term that gives Plan Save Shine a greater contractual advantage than the law permits.

Mandatory consumer and regulatory rights remain unaffected.
